The Oildale man who killed his girlfriend’s nine-year-old son when he backed out of a driveway has had the charges against him dismissed.

A judge ruled Wednesday there was not enough evidence to convict Tony Santiago, who was rushing away from an argument with the boy’s mother when he ran over the kid in June.

Charges against the boy’s mom Clara Marshall were also dropped.
