BAKERSFIELD, CA (KUZZ) — A Kern County jury failed to reach a verdict Wednesday in the case of a Visalia mother facing a murder charge.

The panel told the judge they were stuck on a second-degree murder charge against Maya Herndanez, 20, who allegedly left her two young sons inside a hot car for more than two hours on June 29, 2025, while she had a Brazilian Butt Lift at a medical spa on real Road in southwest Bakersfield.

Hernandez’s lawyer conceded to charges of involuntary manslaughter and child cruelty after Amilio Gutierrez, 1, died from heatstroke with a temperature of 107 degrees. His brother Mateo, 2, survived.

Hernandez reportedly left the car’s air conditioner on, but the vehicle automatically shut off after an hour.

Deliberations resume Thursday.
