Incorrect jury instructions will force a new trial for the family of a Bakersfield doctor who was forced to wait over an hour for stroke treatment after wrecking his car.

65-year-old Mohamad Harb crashed near 24th and Oak streets in 2007, and was seen staggering away from the scene afterward.

Police cuffed him, believing he was drunk.
