The family of the man who was shot dead by Bakersfield Police at a closed Subway shop in Oildale is suing for damages, claiming emotional distress, disregard for the victim’s safety, and fraud. The suit names the city, BPD and officers Chad Garrett and Rick Wimbish for the death Jason Alderman August 22nd, saying surveillance video confirms the 29-year-old was shot in the side and in the back as he crawled through the broken door and did not pose a threat.
