The first person in Kern County to be charged under Proposition 36 has taken a plea deal.
Court records indicate Dustin Towery, 25, pleaded no contest March 28 to a felony count of shoplifting with two prior convictions. A misdemeanor count of resisting arrest was dropped.
Towery was charged on suspicion of stealing two electric scooters valued at nearly $900 from the Target at The Shops at River Walk in December. He faces a year in custody and another year on probation when he’s sentenced April 28.
Under Prop 36, a person with two or more prior theft-related convictions who steals property worth less than $950 could be charged with a felony.
