SECRETARY OF STATE NEEDS ANSWER BY FRIDAY IF VINCE FONG CAN STAY ON THE BALLOT

Secretary of State Shirley Weber has asked a California appeals court for a ruling by this Friday on whether Bakersfield Assemblyman Vince Fong may run for Congress on the November ballot. Chris Micheli from McGeorge School of Law tells 17 News the problem is that the voters have already spoken.

Fong got 42-percent of the vote. Secretary Weber says she needs a decision by April 12th so she can certify the results of the primary. Fong sued when she determined he was ineligible to run for Kevin McCarthy’s seat in Congress, which opened after Fong filed for reelection.
